These Terms and Conditions of Sale (hereinafter: “T&Cs”) apply exclusively between any natural person placing an order and possessing full legal capacity (hereinafter “the Customer”) and Timouny, for all items and services offered on the Website. These T&Cs are permanently displayed on the Website and can be viewed from any page of the Website.
Confirmation of an order on the Website is subject to the Customer’s prior and unconditional review and acceptance of these T&Cs and the applicable rates.
These T&Cs take precedence over any other document.
Timouny reserves the right to amend or modify these Terms and Conditions at any time; the version applicable to any transaction is the one posted on the Website at the time the order is placed.
1 / Products
The items available for sale are those listed on the Site. They are offered subject to the availability indicated on the Site.
Timouny reserves the right to remove any item from the Site or to modify any information associated with the items listed on the Site.
Every effort is made to ensure the accuracy of product presentations and descriptions. While the photographs and descriptions are intended to provide the most accurate representation possible, minor errors may still appear on the Site, which the Customer acknowledges and accepts.
In any event, if the item delivered does not conform to its description on the Site, the Customer is entitled to invoke Timouny’s warranty of conformity, under which Timouny’s liability is limited to refunding the cost of the item, the delivery charges, and the reasonable costs incurred by the Customer to return the item.
2 / Customer
To place an order via the Website, you must first create a customer account.
The Customer creates an account by filling out the form provided with their identification information.
When registering their personal information, the Customer must ensure that the information provided is accurate and complete. In the event of an error, Timouny cannot be held responsible for the inability to deliver the order.
3 / Order
To place and confirm an order, the Customer must follow the online purchasing process, which consists of a series of steps and is completed with the payment of the order. Any order confirmed by the Customer constitutes acceptance of these Terms and Conditions.
A confirmation summarizing the order (products, quantities, prices) will be sent to the Customer via email after the Company receives the order.
4 / Prices and Payment Terms
Product prices on the Site are listed in euros, inclusive of all taxes (TTC), excluding shipping costs.
The shipping cost is specified on the Site before the order is confirmed.
Timouny reserves the right to change product prices at any time; products are billed at the rates in effect at the time the order is placed.
Products are payable in full on the day the order is placed, by credit card or PayPal.
Payment for the order is processed through the secure platform of our partner, WooCommerce Payments. The Customer expressly acknowledges that providing their credit card number to Timouny constitutes authorization to charge their account for the full amount of the products ordered.
5 / Delivery
Timouny strives to ship orders within 2 to 3 business days on average, but this timeframe may be extended during certain periods (such as sales, school holidays, or the Christmas season). In any case, the delivery time will not exceed 15 calendar days from the date the order is placed, provided that full payment has been received.
Deliveries are handled by La Poste, Colis Privé, and Chronopost Pickup. They are made to the delivery address provided by the Customer.
To ensure delivery times are met as accurately as possible, the Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as: recipient’s name, street number, building number, access code, intercom name, pickup point, etc.).
Timouny delivers within mainland France, as well as internationally upon request.
Orders shipped to certain countries may be subject to import taxes and customs fees upon arrival. These costs and any related formalities are the responsibility of the customer/recipient. They must be paid directly to the carrier upon delivery.
6 / Right of withdrawal
Pursuant to the provisions of Article L121-20-2 of the French Consumer Code, goods manufactured to the Customer’s specifications or significantly personalized at the Customer’s request are not subject to the right of withdrawal and will not be accepted for return or exchange, except in cases where the warranty for defects affecting the sold goods is invoked.
For all other products, the Customer has the right to cancel their order at any time within 14 days of the date on which they received the products.
The Customer therefore has a period of 14 days from the date of delivery to exercise their right of withdrawal without having to provide a reason or pay any penalties.
7 / Returns and Refunds
The Customer may request a refund for their order by emailing contact.timouny@gmail.com within 14 days of receiving the order. The Customer is responsible for the cost of returning the products.
The products in question must be returned in their original packaging, in their original condition, new, and undamaged.
Once the products have been received and the return approved, Timouny undertakes to refund the full cost of the returned products, as well as the order’s shipping costs, as soon as possible and in accordance with Article L-121-20-1 of the French Consumer Code, no later than 30 days following the date on which this right was exercised.
In any case, Timouny will cover the return shipping costs if the delivered product was damaged or different from the product ordered.
8 / Warranties and Liability
The Products are guaranteed against lack of conformity and latent defects under the terms set forth in Articles L 211-1 et seq. of the Consumer Code and Articles 1641 through 1649 of the Civil Code, effective from the date of delivery:
Article L-211-4 of the Consumer Code: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation was the seller’s responsibility under the contract or was carried out under the seller’s supervision.
Article L-211-5 of the Consumer Code: To be in conformity with the contract, the goods must:
1° Be fit for the purpose for which goods of the same type are ordinarily intended and, where applicable:
– correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
– possess the qualities that a buyer may legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, particularly in advertising or labeling;
2° Or possess the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the seller’s attention, and accepted by the seller.
Article L-211-12 of the Consumer Code: The right to bring an action for lack of conformity expires two years after the delivery of the goods.
Article 1641 of the Civil Code: The seller is liable for hidden defects in the item sold that render it unfit for its intended use, or that so impair its use that the buyer would not have purchased it, or would have paid a lower price for it, had the buyer been aware of such defects.
Article 1648, paragraph 1, of the Civil Code: An action based on latent defects must be brought by the purchaser within two years of the discovery of the defect.
9 / Customer Service
For any information or questions, to track an order, or to exercise the right of withdrawal, the Customer may contact customer service by email by filling out the contact form on the Website, or by phone at 06.75.49.96.34, Monday through Friday from 9:00 AM to 5:30 PM.
10 / Liability
Timouny has an obligation to achieve a specific result for all stages of the order process as well as for the stages following the conclusion of the contract.
Timouny therefore undertakes to describe the products sold on the Site as accurately as possible. However, Timouny shall not be held liable in the event that its failure to fulfill its obligations is attributable either to an unforeseeable and insurmountable act by a third party not party to the contract or to a force majeure event as defined by French case law. Similarly, Timouny shall not be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, unauthorized access, or the presence of computer viruses.
In the event of a force majeure event, Timouny will notify the user/buyer within 5 business days of the occurrence or threat of such an event.
The parties agree that they shall consult with each other as soon as possible to jointly determine the terms for fulfilling the order during the period of force majeure. If the interruption due to force majeure lasts longer than one month, Timouny may choose not to fulfill the order, in which case it shall be responsible for refunding the buyer.
11 / Governing Law and Jurisdiction
These Terms and Conditions are governed by French law with respect to both substantive and procedural matters. Any dispute must first be subject to an attempt at amicable resolution. In the absence of an amicable resolution, jurisdiction is assigned to the French courts, notwithstanding the presence of multiple defendants or the introduction of third-party claims.
The Website complies with French law; however, Timouny does not guarantee compliance with any local laws that may apply to you if you access the Website from other countries.
12 / Cookies
In order to process the Customer’s order, and to better understand their needs and personalize the services offered on the website, Timouny uses cookies. A cookie is a small text file stored on the Customer’s computer’s hard drive that is used to track their visit to the website.
Cookies store information about the customer’s time on the site, their identity (identified by their email address and password), and the contents of their shopping cart. Once the customer logs out of the site, this information is stored for 30 days before being permanently deleted.
Customers may opt out of cookies by adjusting their web browser settings. Doing so will result in the loss of any personalized features of the service offered on the website. We assume no liability for any consequences arising from the impaired functioning of our services resulting from our inability to store or access the cookies necessary for their operation, which you have refused or deleted.
